Welcome to PsychDesk, a digital platform thoughtfully designed to empower mental health professionals. By accessing, registering, or using PsychDesk (referred to as "the Platform," "we," "us," or "our"), you agree to comply with and be bound by these Terms and Conditions.

These terms govern your use of all services provided through www.psychdesk.in and its subdomains, mobile applications, or any related digital interfaces operated by PsychDesk.

If you do not agree with these terms, please refrain from using our services.

1. Purpose of PsychDesk

PsychDesk is a professional platform built exclusively for licensed mental health practitioners, psychologists, counselors, and wellness experts. Our aim is to simplify practice management, streamline administrative workflows, and enable professionals to focus on their clients' wellbeing.

The platform provides features such as:

• Online bookings and client scheduling.
• Digital calendar and task management.
• Therapy note templates and outcome tracking.
• Secure client data management.
• Automated invoicing and payment tracking.

PsychDesk is not a healthcare provider. It does not offer clinical or medical advice, diagnosis, or treatment to end clients. The responsibility for professional judgment, diagnosis, and therapy delivery rests solely with the therapist or practitioner.

2. Acceptance of Terms

By registering on PsychDesk, you acknowledge that you:

• Are a licensed professional authorized to provide mental health or wellness services.
• Understand and agree that PsychDesk serves as a technology enabler, not a substitute for professional discretion or therapeutic judgment.
• Consent to data collection, processing, and usage in line with our Privacy Policy and the Digital Personal Data Protection Act, 2023 (DPDPA).

3. User Accounts and Responsibilities

a. Account Creation

You must provide accurate and complete information when creating your PsychDesk account. You are responsible for maintaining confidentiality of your login credentials and all activities under your account.

b. Account Use

You agree to:

• Use the platform only for lawful and professional purposes.
• Avoid sharing login access with unauthorized persons.
• Immediately report any suspicious activity or unauthorized access to support@psychdesk.in.

PsychDesk reserves the right to suspend or terminate accounts found violating usage policies or ethical standards.

4. Service Access and Availability

We strive to offer uninterrupted access to the platform, but availability may occasionally be affected by:

• Scheduled maintenance or feature upgrades.
• Server downtime or connectivity disruptions.
• Events beyond our control (natural disasters, cyberattacks, etc.).

PsychDesk will make reasonable efforts to notify users in advance of planned maintenance or downtime.

5. Subscription Plans and Payments

PsychDesk operates on a subscription-based model. By subscribing, you agree to:

• Pay applicable fees based on your selected plan.
• Maintain valid payment information through our authorized payment partners (e.g., Razorpay, PayU).
• Understand that subscription fees are non-refundable except where mandated by law.

We may revise pricing, introduce new plans, or modify existing features from time to time. Changes will be communicated clearly prior to implementation.

6. Therapist–Client Relationship

PsychDesk does not engage in any therapist–client relationship. All sessions, communications, and exchanges that occur between therapists and their clients are:

• Solely governed by the therapist's professional ethics and obligations.
• Confidential as per the therapist's applicable laws and professional codes.
• Managed and stored under the therapist's discretion using PsychDesk tools.

PsychDesk merely provides a secure digital environment for professionals to organize and manage their practice.

7. Data Ownership and Confidentiality

• All data entered by the therapist — including client records, session notes, and invoices — remains the sole property of the therapist.
• PsychDesk acts only as a Data Processor, handling data on behalf of the therapist (Data Fiduciary) under the DPDPA, 2023.
• PsychDesk will never access, sell, or share client data for advertising or non-operational purposes.
• We use advanced encryption, localized storage, and restricted access controls to ensure confidentiality at every stage.

8. Compliance with DPDPA, 2023

PsychDesk fully complies with the Digital Personal Data Protection Act (DPDPA), 2023, ensuring that:

• Data is collected only with clear and informed consent.
• Processing is limited to specific, lawful, and legitimate purposes.
• Users have the right to access, correct, and delete their data.
• Consent withdrawal and grievance redressal mechanisms are available and transparent.

9. Restrictions on Use

You agree not to:

• Misuse, copy, or redistribute platform content or code.
• Attempt to access restricted sections or data of other users.
• Upload malicious content, spam, or files that could harm the system.
• Use the platform for illegal, unethical, or non-professional activities.

Violations may lead to immediate suspension, termination, or legal action, as applicable.

10. Intellectual Property Rights

All platform content — including the name PsychDesk, logo, interface design, and technology architecture — is the intellectual property of Ayrelune Credence Private Limited.

You are granted a limited, non-transferable, non-exclusive license to use PsychDesk for your professional activities. Reproduction, distribution, or modification without written consent is strictly prohibited.

11. Third-Party Services

PsychDesk may integrate with third-party tools (such as payment gateways, video conferencing, or analytics). While we carefully select partners with strong privacy standards, we are not responsible for their independent practices.

You are encouraged to review their respective privacy policies before enabling any integration.

12. Limitation of Liability

PsychDesk is a technology platform that facilitates administrative workflows. We do not assume liability for:

• Therapeutic outcomes or client progress.
• Accuracy or completeness of information entered by users.
• Damages arising from misuse, technical errors, or service interruptions.

To the fullest extent permitted by law, PsychDesk's liability is limited to the amount paid by the user for the current subscription term.

13. Indemnification

You agree to indemnify and hold harmless PsychDesk, its affiliates, directors, and employees from any claims, damages, or liabilities arising out of:

• Violation of these terms.
• Breach of professional or ethical standards.
• Misuse of the platform or unauthorized disclosure of client information.

14. Termination of Access

PsychDesk may suspend or terminate your access if:

• You breach these Terms or misuse the platform.
• Legal or regulatory compliance requires such action.
• Requested by law enforcement or authorities.

Upon termination, your access to data and platform features will cease, but you may request a data export within 30 days of account closure.

15. Dispute Resolution and Governing Law

These Terms are governed by and construed in accordance with the laws of India. In case of disputes, both parties agree to attempt resolution through mutual discussion. If unresolved, disputes will be subject to the exclusive jurisdiction of the courts in Bengaluru, Karnataka, India.

16. Modifications to Terms

PsychDesk reserves the right to modify these Terms and Conditions at any time. Users will be notified of substantial updates via email or dashboard alerts. Continued use after such notification constitutes acceptance of the updated terms.
